These Terms of Service ("Terms") govern your use of the BodyCorporateFees.com website located at https://bodycorporatefees.com (the "Website"), operated by BodyCorporateFees.com ("we", "us", or "our").

By accessing or using our Website, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Website.

1. Use of Website

Acceptable Use

You may use our Website for lawful purposes only. You agree not to:

  • Use the Website in any way that violates Australian laws or regulations
  • Attempt to gain unauthorised access to our systems or networks
  • Interfere with or disrupt the Website or servers
  • Transmit any viruses, malware, or harmful code
  • Collect or harvest any data from the Website using automated means without authorisation (authorised API key holders are exempt - see Section 1.3 below)

Email Notifications

By providing your email address, you consent to receive communications from us about suburb overview availability for your suburb, contributor benefits (including discount codes), service updates, and related information. You may unsubscribe at any time.

API Access and Programmatic Use

We provide API access for authorised developers, businesses, and AI agents that need programmatic access to our data. If you are an API key holder:

  • How to obtain a key: API keys are issued upon request by contacting us at [email protected]
  • Authorised use: API key holders may access the service programmatically and are exempt from the automated data collection prohibition above
  • Scope of access: API keys grant access to public suburb data endpoints only. Premium suburb reports remain available for human purchasers only and cannot be accessed via the API
  • Non-transferable: API keys may not be shared, sold, or transferred to any third party. Each key is issued to a specific individual or organisation
  • Rate limits: API key access is subject to rate limits (requests per hour). Exceeding limits will result in temporary request throttling (HTTP 429)
  • Revocation: We reserve the right to revoke API keys at any time for misuse, violation of these Terms, or at our discretion. Revoked keys cannot be reinstated - a new key must be requested
  • API specification: The OpenAPI specification for all available endpoints is published at /api/openapi.json
  • All other terms apply: API key holders remain bound by all other provisions of these Terms, including sections on intellectual property, disclaimers, and limitations of liability

2. Contributor Discount Codes

Contributors who provide fee data and an email address receive a discount code for premium suburb report purchases:

  • Single-use only: Each discount code can only be used once
  • Non-transferable: Codes are linked to the email address provided and cannot be transferred to another person
  • One per contribution: One discount code is issued per suburb contribution
  • Email required: Discount codes are only available when you provide an email address with your contribution
  • Validity: Codes are valid indefinitely unless misused or fraudulently obtained
  • Revocation rights: We reserve the right to revoke discount codes for misuse, fraud, or violation of these Terms
  • No cash value: Discount codes have no cash value and cannot be exchanged for money
  • Subject to change: Discount amounts are subject to change for future discount codes (existing codes honor their original discount amount)
  • Suburb-specific: Each discount code is valid only for the suburb it was issued for

3. Premium Reports and Paid Content

Premium suburb reports and other paid content purchased through our Website are subject to the following terms:

License Grant

  • Personal use license: Premium reports are licensed to you for personal or internal business use only
  • Single-user license: Each purchase grants a license to one individual or entity
  • Non-exclusive: The license is non-exclusive - we may sell the same report to multiple purchasers
  • Non-transferable: You may not transfer, assign, or sell your license to another person or entity

Usage Restrictions

You may NOT:

  • Share or distribute: Forward, share, or distribute premium reports to any third party (including family members, colleagues, friends, or business associates)
  • Resell or sublicense: Resell, sublicense, or use premium reports as part of a commercial service
  • Public posting: Post or upload premium reports to any public website, forum, social media platform, or file-sharing service
  • Create derivative works: Modify, adapt, or create derivative works from premium reports
  • Remove attribution: Remove or obscure any watermarks, copyright notices, or identifying information
  • Multiple accounts: Purchase a single report and share it across multiple users or entities

Report Tracking and Identification

We reserve the right to:

  • Include unique identifiers, watermarks, or tracking information in premium reports
  • Associate reports with purchaser information (email address, payment details, IP address, timestamp)
  • Monitor and investigate unauthorised distribution of premium reports
  • Use forensic techniques to trace the source of unauthorised sharing

Payment and Refunds

  • One-time payment: Premium reports are sold as one-time purchases (not subscriptions)
  • Immediate access: You receive immediate access to your purchased report upon successful payment
  • Refund policy: Due to the instant digital nature of premium reports, all sales are final. Refunds will only be provided in exceptional circumstances such as:
    • Technical errors preventing report access
    • Duplicate purchases made in error
    • Significant data quality issues (as determined by us)
  • Refund timeframe: Refund requests must be made within 7 days of purchase
  • No refunds after sharing: Refunds will not be granted if there is evidence of report sharing or distribution

Enforcement and Violations

If we detect or are notified of unauthorised sharing or distribution of premium reports:

  • We may immediately revoke your access to purchased reports and your account
  • We may refuse future purchases from you
  • We may pursue legal action for copyright infringement and breach of contract
  • You may be liable for damages including but not limited to:
    • The retail value of reports shared multiplied by the number of recipients
    • Our legal costs and expenses
    • Any additional damages permitted by law

Data Currency and Updates

  • Point-in-time data: Premium reports reflect data available at the time of purchase
  • No automatic updates: Reports are not automatically updated with new data submissions
  • Repurchase for updates: To access updated data, you must purchase a new report
  • Data accuracy: While we strive for accuracy, we make no guarantees about the completeness or accuracy of data in premium reports (see Section 8 - Data Accuracy)

4. Intellectual Property

All content on this Website, including text, graphics, logos, images, and software, is the property of BodyCorporateFees.com or its licensors and is protected by Australian and international copyright laws.

You may view and print pages from the Website for personal, non-commercial use only. You may not:

  • Modify, copy, or create derivative works from our content

5. Disclaimer of Warranties

  • Data accuracy depends on user submissions and may contain errors
  • We do not verify all submitted information
  • Comparisons are for informational purposes only

  • We are not responsible for decisions made based on information from our Website
